Cancellation and refund policy

1. Cancellation of a transaction by the customer

1.1. You may cancel the purchase you made on the website within 14 days from the date of receipt of the product, or from the date of receipt of the transaction details document as defined in the terms of use of the website and in accordance with the conditions detailed in this policy below.

1.2. Notwithstanding the foregoing, a customer who is a person with a disability, a senior citizen, or a new immigrant (as these terms are defined in the law) may cancel their purchase within 14 days from the date of the transaction, the date of receipt of the product, or the date of receipt of the transaction details document, whichever is later, provided that the transaction included a conversation between the business and the consumer, including through electronic communication. Please note that the Company may request documentation as specified in the law to verify the customer's status as a person with a disability, a senior citizen, or a new immigrant, as applicable.

1.3. Notwithstanding the above, the right to cancel does not apply to purchases where cancellation rights are limited by law, unless expressly stated otherwise herein. This includes perishable products, such as nutritional supplements that require storage under controlled conditions.

1.4. To the extent that the customer has the right to cancel the purchase in accordance with the terms of this policy as detailed above and below, and/or in accordance with the law, the purchase may be canceled by delivering a cancellation notice to the company in any of the following ways:

3) Through a dedicated link displayed on the website www.mimiherbs.com

1.5. The cancellation notice must include the customer's name and ID number. The customer may also specify the reason for cancellation.

1.6. In the event of a purchase cancellation for reasons other than those specified in Section 1.7 below, the Company will refund within 14 days of receiving the cancellation notice that part of the purchase price actually paid by the customer for the product whose purchase is requested to be canceled, the Company will cancel the charge for the purchase, provide a copy of the charge cancellation notice to the customer, and will not charge the customer any amount other than a cancellation fee at a rate not to exceed 5% of the price of the product whose purchase is requested to be canceled or 100 new shekels, whichever is lower.

1.7. Cancellation due to product defect, non-conformity, late delivery, or other breach – If the purchase is canceled due to a product defect, if the product does not conform to the details provided to the customer in the transaction details document or as prescribed by law, if the product is not delivered by the date specified in the Company's delivery policy, or due to any other breach of the terms of use by the Company, the Company will refund within 14 days of receiving the cancellation notice the portion of the transaction price actually paid by the customer for the product being returned, cancel the charge for the purchase, provide a copy of the charge cancellation notice to the customer, and will not charge any cancellation fees.

1.8. Products may be returned to the company via registered mail or courier as detailed below:

(a) You must pack the items in their original packaging;

(b) Write the following address on the returned package: Agan Industries, 36 Moshe Sharett Street, Rishon LeZion.

(c) Affix the collection label to the package;

(d) Go to the post office and send the package to the address shown on the collection label;

(e) It is recommended to obtain a reference number from the post office for proof of delivery.

2.       Cancellation by the company

2.1. Without derogating from any right the Company has under any law or the Terms of Use, the Company reserves the right to cancel the purchase in whole or in part, or not to approve it in whole or in part, in the following cases;

• If it is determined that the product is not in stock for any reason;

• If the customer violated the terms of use of the site or committed an act contrary to the provisions of the law;

• If an error was made in the presentation of the product on the website, including an error in the description, price, or shipping details;

• In the event of a malfunction or other event that prevents or delays the arrival of the products on time or at all, including the occurrence of a force majeure event;

• If the credit card details or the customer's complete details were not recorded in the company's systems.

2.2. The Company will notify the customer of any such cancellation or non-approval by email to the address you provided. The Company will not be responsible or liable for any direct, indirect, consequential, or special damages caused to the customer or any third party as a result of such purchase cancellation.

3. This product return policy does not limit any rights provided under applicable law, including regarding transaction cancellations.
